A Report of the international gathering held in Florence to celebrate the 10th Anniversary of the Convention on the Rights of the Child, with special reference to children of minorities, indigenous peoples and immigrants. The meeting was attended by youth participants who later joined international experts and practitioners at three technical workshops focusing respectively on: legal protection and access to basic services for children of minorities and indigenous peoples; legal protection and access to basic services for children of immigrants, refugees and asylum-seekers; children in situations of armed conflict and peace-building initiatives. The young delegates concluded the meeting by presenting their own Declaration on non-discrimination.

In occasione del decennale della Convenzione delle Nazioni Uniti sui Diritti dell’Infanzia, la Regione Toscana, il Comitato Nazionale per l’UNICEF e il Centro di Ricerca Innocenti dell’UNICEF hanno organizzato un incontro internazionale di giovani. Il tema centrale è stato il principio della non-discriminazione sancito dall’articolo 2 della Convenzione sui Diritti dell’Infanzia. I giovani hanno partecipato con esperti e attivisti in tre seminari tecnici che si sono occupati rispettivamente di: tutela giuridica e accesso ai servizi di base per i bambini delle minoranze e dei popoli indigeni; tutela giuridica e accesso ai servizi di base per i bambini degli immigranti, dei profughi e dei richiedenti asilo; bambini in situazioni di conflitto armato e iniziative di costruzione della pace. I giovani hanno concluso l’incontro presentando la loro propria dichiarazione sulla non-discriminazione, ‘Il Proclama dei Giovani’.

Questo numero di Innocenti Digest affronta il tema della violenza domestica, una delle forme globalmente più diffuse di violenza contro le donne e le ragazze, che però rimane relativamente nascosta e ignorata. Il problema della violenza domestica chiama in causa una varietà di ambiti: la sanità, la giustizia, l'economia, l'istruzione, lo sviluppo e, soprattutto, i diritti dell'uomo. Il Digest esamina le dimensioni e la diffusione del problema, e le ripercussioni che esso ha sui diritti delle donne e dei minori. Sottolinea l'esigenza di fornire risposte politiche coordinate e integrate: con una più efficace applicazione della legislazione esistente e con un impegno più diretto e visibile nella lotta contro questa violenza da parte dei governi. Lo studio contiene inoltre informazioni sulle ONG regionali e internazionali attive su questo tema, oltre che indicazioni bibliografiche utili per approfondire l'argomento.

The UN Convention on the Rights of the Child affirms that every child has a right to education. The purpose of education is to enable the child to develop to his or her fullest possible potential and to learn respect for human rights and fundamental freedoms. The general principles of the Convention which are relevant to education cover non-discrimination, the best interests of the child, the child’s right to life, survival and development, and the child’s right to express opinions. These principles can serve as a useful instrument in discussions on how to reform schools. This paper analyses, in the light of the Convention, eight areas for progressive reform: universal access, equal opportunities, the appropriate content of education, cultural roots and global values, new methods of learning, mutual respect, pupil participation, and the role of teachers, parents and the community. It also examines the problems both of implementing and of paying for such reform. The author concludes that the Convention constitutes a useful agenda for creatng a school which is child friendly and which provides the most effective learning.

The Convention on the Rights of the Child has now been ratified by 192 nations. Notwithstanding, securing the principles and necessary legal safeguards remains a difficult achievement. Laws and jurisprudence must be firmly linked to the national reality to avoid them being well-meant placebos. Are all children comprehensively protected and defended? Do the means for implementing these laws exist? Is monitoring adequate? These are on-going questions of concern for both UNICEF and the broader international children's rights community. Many of the themes raised in this essay also echo those examined in other ICDC series and studies; violence against children, juvenile offenders, street children, are all inter-related problems for which children have the right to expect effective and full legal protection.

It also covers prevention questions. Like previous publications in the series, it contains practical information on the major players and sources of further, more detailed information. Todo niño tiene derecho a la educación. Esto es lo que establece la Convención de las Naciones Unidas sobre los Derechos del Niño. El objetivo de la educación es permitir al niño desarrollar su potencial en la mayor medida posible y aprender a respetar los derechos humanos y las libertades fundamentales. Los principios generales de la Convención relacionados con la educación comprenden la no discriminación, el interés superior del niño, el derecho del niño a la vida, a la sobrevivencia y al desarrollo y el derecho del niño a expresar libremente sus opiniones. Estos principios pueden ser un instrumento de gran utilidad en el debate sobre los métodos a seguir para llevar a cabo reformas en el sistema escolar. Esta conferencia estudia, a la luz de la Convención, ocho de las áreas que exigen una reforma progresiva: el acceso generalizado, la igualdad de oportunidades, el contenido adecuado de la educación, las raíces culturales y los valores globales, los nuevos métodos de aprendizaje, el respeto mutuo, la participación de los alumnos y el papel de los maestros, los padres y la comunidad. La conclusión del autor es que la Convención, al presentar un resumen útil de los asuntos a tratar, sirve de marco de referencia para poder crear escuelas que sean realmente a la medida del niño y que brinden una enseñanza eficaz.

Tout enfant a droit à l'éducation. Cela est affirmé dans la Convention relative aux droits de l'enfant proclamée par les Nations Unies. Le but de l'éducation est de permettre à l'enfant de développer au maximum ses possibilités et d'apprendre le respect des droits de l'homme et des libertés fondamentales. Les principes généraux de la Convention se rapportant à l'éducation couvrent la non-discrimination, les intérêts de l'enfant, le droit de l'enfant à la vie, à la survie et au développement, et le droit de l'enfant à exprimer ses opinions. Ces principes peuvent constituer un instrument utile dans les débats sur la réforme des écoles. Ce document analyse, à la lumière de la Convention, huit thèmes au service d'une réforme progressive: accès universel, égalité des chances, contenu adéquat de l'éducation, racines culturelles et valeurs globales, nouvelles méthodes d'apprentissage, respect mutuel, participation des élèves, et rôle des enseignants, des parents et de la communauté. Il examine également les problèmes de mise en oeuvre et de financement d'une telle réforme. L'analyse dans son ensemble s'appuie sur l'expérience pratique d'Etats contractants en ce qui concerne l'application de la Convention dans leurs écoles.

Children, Law and Justice: A South Asian Perspective

Even though all South Asian countries have ratified the UN Convention on the Rights of the Child, there is as yet little awareness in the region of the importance of this Convention at various levels including policy planning, activism and legal reform in the on-going effort to achieve children’s rights. Thus argues Savitri Goonesekere, whose primary objective in this book is to outline the options available for using the Convention to create a legal system favourable to the realization of the rights of the child in South Asia. The first chapters discuss the international legal environment and the assumptions underlying South Asian domestic legislation on children’s rights, together with the conceptual framework of the Convention. The core of the book focuses on ‘best interests’ and examines such issues as trafficking in children, the status of the girl child, adoption and foster care, child prostitution, and the child as victim of abuse and violence.
